This table has been created as a guide to assist customers on what forms may need to be lodged for dealings involving a community titles scheme.

It sets out the non-plan forms used in community titles dealings and shows whether they are to be lodged as documents or evidence.

Dealings Involving a Community Titles Scheme

New schemes

PURPOSE DOCUMENT NAME (AND TYPE) EVIDENCE (that may be required)
1. Registration new scheme

Application to register a community titles scheme (CA)

  • Written consent of all type 1 and type 2 interest holders (to the subdivision of the parcel or lot by the community titles scheme) (or consent endorsed on the Notice to type 1 and type 2 interest holders for consent to subdivision and schedule of unit entitlements)
  • Written consents from type 1 and type 2 interest holders and/or other registered interest holders (for purposes other than to the subdivision of the parcel or lot by the scheme, e.g. creation of s.136C TLA easement)
  • Completion of the Statement to deal with land section on the form, if applicable
Scheme notice (SN) N/A
Community titles scheme by-laws (SB)
  • Written consent of owners of special lots are required when making, amending or repealing exclusive use by-laws. Where all lots in the scheme are special lots, the owner will be the community corporation.

Application to register a community development statement or amendment (CD)

  • The community development statement or consolidated version of the community development statement incorporating the numbered amendment as relevant, endorsed with the approval of Planning Commission.

  • The community development statement or consolidated version of the community development statement incorporating the numbered amendment as relevant, endorsed with the approval of Planning Commission.

3. Subdivision of a lot(s), and/or common property (excluding subdivision of a lot by a community titles scheme)

Application to register a community development statement or amendment, (CD) if applicable

Community titles scheme by-laws (SB)
  • Written consent of owners of special lots when making, amending or repealing exclusive use by-laws. Where all lots in the scheme are special lots, the owner will be the community corporation.
  • Written consent of Planning Commission or Local Government (as relevant) when amending or repealing by-laws under planning (scheme by-laws) condition

10. Restricted Use
