2023 Strata manager Annual Returns open & required by 31 March

 

The 2023 Strata manager Annual Returns are officially open for submission!  This is a crucial opportunity for you to make your voice heard and play a role in shaping future policies that will guide the Strata Industry.

Key information

·         Deadline: 5pm, 31 March 2024

·         How to submit: Complete the annual return on the Landgate submission portal webpage. 

·         Mandatory requirement: As per the Strata Titles Act 1985, all Strata managers are required to submit their annual return by the deadline.

Enhancements for your convenience

The online portal has undergone improvements, allowing you to save your progress if completing the return from the same device.

A checklist of required information is now available in the portal to aid you in completing the return.

The specific provisions are contained in:

·         STA section 153 and

·         Regulation 102 of the Regulations.

 

Landgate Requisition Portal coming soon

 

On 7 August 2023, changes to the Transfer of Land Act 1893 came into effect. These changes enabled the electronic service of statutory notices from the Registrar of Titles and the Commissioner of Titles. This included the ability for Landgate to email requisition notices to document lodging parties where a lodged document has not met the registration requirements.

As communicated in CIB 411 on 21 July 2023, Landgate has now developed a secure Requisition Portal where lodging parties can upload their evidence to satisfy a requisition as well as pay for any regulated requisition fees online.

Those lodging documents should ensure their contact details on all documents include an email address to ensure requisitions can be received via email if required.

For more information on the Requisition Portal, visit the Landgate website. Additional information will be provided when the Requisition Portal is launched in early February 2024.

Interoperability update 

 

In 2024 we will continue working toward a fully digital registry and a competitive electronic conveyancing market as part of our commitment to the Australian Registrars National Electronic Conveyancing Council (ARNECC).

Version 7 of the Model Operating Requirements (MOR) and Model Participation Rules (MPR) are in the final stages of development and approval and will be published in the coming weeks. As part of the usual process, feedback tables from the two rounds of consultation in the development of version 7 of the MOR and MPR will also be published on the ARNECC website. Further information regarding take effect dates will be included in the February bulletin.

Interoperability will be a focus of ARNECC and Land Registries throughout 2024 after the successful day 1 transaction in September 2023 (Day1 -ARNECC Statement).

A ministerial forum was held in November 2023, with Ministers from all jurisdictions reiterating their support for competition via interoperability in the electronic conveyancing market.

The scope of interoperability releases was also settled in November, after significant collaboration between ELNOs and other industry Land Registry representatives. 

 

Developing electronic lodgement capabilities

 

As we embark on the journey towards a more streamlined and efficient future, we continue to develop our electronic lodgement capabilities. 

Our commitment is underscored by ongoing industry consultations aimed at creating solutions for electronic lodgement of all plans in a digital data format.

We encourage everyone to leverage the current residual documents wherever possible. They have been designed to enhance convenience, reduce paperwork, and facilitate a smoother transition to the digital era.
