Summary
The Department of Primary Industries and Regional Development (DPIRD) administers the Biosecurity and Agriculture Management Act 2007 (BAM Act), and may issue notices directing persons in charge of places to take certain actions to control, eradicate or exclude organisms that are declared pests under the Act.  These notices are binding on the current and subsequent owners and occupiers. 
Description
The Department of Primary Industries and Regional Development (DPIRD) administers the Biosecurity and Agriculture Management Act 2007 (BAM Act).  Under the Act, organisms that are considered harmful to other organisms, the environment, human beings or agricultural activities are declared to be pests, and persons (e.g. owners, occupiers) who are in charge of land infected or infested with a declared pest have a standing obligation under section 30 of the Act to take measures to control that pest.

DPIRD may issue notices under the Act and BAM Regulations directing owners, occupiers or persons in charge of places to take certain actions to control, eradicate or exclude organisms that are declared pests under the Act.  These notices may be issued to provide information on best practice control methods, or to ensure a co-ordinated and consistent approach to control is being taken within a region or area.  They may also be given if a person is considered to fail to satisfy their obligation to take control measures. 

Failure to comply with a notice under the BAM Act may constitute an offence.

Effective control measures may take some time to implement, e.g. over several seasons or generations of an organism, so a notice may remain in effect for an extended period.  Notices under the BAM Act are binding on the current and subsequent owners and occupiers.
